Alorica Inc., inclusive of all subsidiaries and affiliates (“we,” “us,” “our” or “Alorica”), is a multinational corporation supporting businesses in several highly regulated business verticals including financial services, telecommunications, and healthcare.  We are committed to respecting the privacy rights of all individuals we encounter, such as our clients, our clients’ customers, and our employees, and are committed to handling Personal Information responsibility, with integrity, and in accordance with all applicable laws.   

The purpose of this Privacy Policy is to explain to you the Personal Information we may collect about you and how we may process that Information. We will also explain who you can contact about concerns you have regarding your Personal Information.  And through this Policy, we announce our commitment to the protection of your Personal Information and to ensure the appropriate technical and organizational measures to protect such information against unauthorized or unlawful processing and against accidental loss, alteration, disclosure, or access, and accidental or unlawful destruction or damage thereto, and to abide by all applicable laws including:

Our website allows you to learn about the services Alorica offers and identifies potential job openings for prospective employees.  In general, you can visit our website without revealing any information about yourself.  

By visiting this website, Alorica will share and log IP addresses shared and logged.  We may link IP addresses to personally identifiable information for authorized uses, such as marketing.  In addition, cookies may be created and shared as part of the browsing process.  Please see our Cookie Notice for further details.   

Should you provide any information in the forms provided – either as a prospective client or as a prospective employee, or for any other reason – we will use that information provided for those purposes only, as is more fully described below.

Protecting Children’s On-line Privacy

We do not sell products for purchase by children, nor is our website intended to market our services to children.  We comply with the Children’s Online Privacy Protection Act (COPPA) and recognize the importance of protecting the privacy of children. Accordingly, our website does not intend to target or attract children, and pursuant to COPPA, we will not knowingly collect any Personal Information from children under the age of 13.

Personal Information We Process
What is Personal Information? 

Personal Information is any information that identifies you.  Examples of Personal Information Alorica might possess are more fully outlined below, but may include your name, pronoun, email address, phone numbers, physical address, date of birth, age, and so forth.  This may include data that you provide to us, that we collect about you from third parties including our clients, or that we assign to you.   

What is Sensitive Personal Information? 

Alorica may collect and process certain special categories of Personal Information (“Sensitive Personal Information”) about you where required by applicable law, where necessary for the establishment, exercise, or defense of legal claims, or, where necessary, you have provided explicit (and, where applicable, written, or separate) consent.  

Subject to applicable law, Alorica may process information about:  

  • physical and/or mental health for the purposes of addressing potential workplace health, safety and accommodation issues and assessing absence data during the recruitment process, 

  • criminal charges/convictions or unlawful behavior for recruitment and pre-employment screening purposes and for the assessment of registration and licensing requirements, 

  • data related to sexual orientation, race and/or ethnic origin, gender, gender identity and gender expression, physical and/or mental health for purposes of reporting on diversity and inclusion statistics, complying with government reporting requirements, and/or other legal obligations, 

  • biometric data, such as fingerprints and iris scans, for the purposes of electronic identification, authentication, and corporate security, at secured Alorica premises.  

We process Sensitive Personal Information in your jurisdiction if and to the extent permitted or required by applicable law. We will also seek to protect such information using similar strict security measures as further described below for Personal Information.   

Who is covered by this Policy? 

This Policy applies to the handling of Personal Information of anyone we process Personal Information from, including prospective employees, current employees, former employees, prospective clients, current clients, former clients, employees of such clients, clients’ customers, our customers, guests, or external staff (“you,” “your”).     

What Personal Information do We process? 

We access, collect, use, and store (collectively “process”) different types of Personal Information about you as necessary in the ordinary operation of our business.  The Personal Information we may process includes: 

Name and contact information. Your first and last name, employee identification number/ social security number, email address, date of birth, mailing address, phone number, photo, beneficiary and emergency contact details, and other similar contact information.  

Demographic information. Your date of birth and gender as well as more Sensitive Personal Information including information relating to racial and ethnic origin, religious, political, or philosophical beliefs, information about your health, disabilities, sexual orientation, gender identity, and transgender status. We may also ask about your parental status and military status. 

National identifiers. Your national ID/passport, citizenship status, residency and work permit status, social security number, or other taxpayer/government identification number. 

Employment details. Your job title/position, office location, employment contract, offer letter, hire date, termination date, performance history and disciplinary records, training records, leave of absence, sick time, FMLA requests, and vacation/holiday records. 

Spouse’s/partner’s and dependents’ information. Your spouse and dependents’ first and last names, dates of birth, and contact details, and any other information necessary for the purposes collected. 

Background information. Your academic and professional qualifications, education, CV/Resume, credit history and criminal records data (utilized for background screening and vetting purposes where permissible and in accordance with applicable law and consultation requirements). 

Video, voice, and image. Video, voice, and image data gathered in the court of Alorica providing services. 

Financial information. Your bank account details, tax information, salary, retirement account information, company allowances and other information necessary to administer payroll, taxes, and benefits. 

Feedback and sentiment information. Your responses to employee surveys and feedback collected about managers and co-workers. 

Workplace, device, usage, and content data. Application data (such as data from Office 365, Teams, Outlook, or internal business processes) including emails sent and received, calendar entries, to-do items, instant messages, building and information system access, system, and application usage (including telemetry) when accessing and using Alorica corporate buildings and assets as well as client system data.  

Credit card/ payment vehicle information.  Information about financial products such as credit cards, or other payment vehicles, including account numbers, security validation numbers, and other information necessary to process payments.   

Information from your own device. Personal Information from your own device if you are performing work related functions on that device – i.e., “Bring Your Own Device” (BYOD). 

Internet Protocol address (IP Address).  Numerical labels assigned to your devices when you visit our website.   

Information from third parties.  Personal Information about you from third parties or public sources as needed to support the employment relationship or to engage with you concerning job opportunities at Alorica. For example, before and during your employment or assignment with Alorica, we may collect information from public professional networking sources, such as your LinkedIn profile, for recruitment purposes.  

We also may conduct lawful background screenings, to the extent permitted by law, through a third-party vendor for information about your past education, employment, credit and/or criminal history. In the event of a natural disaster or other life/safety emergency, we may rely on public social media posts or other public sources to account for employees if otherwise unable to contact them.  

Additionally, if there is an investigation of an incident involving employees, we may obtain information relevant to the incident from external sources including private parties, law enforcement, or news sources and public social media posts. 

How do we collect your Personal Information? 

We may collect Personal Information from the following sources: 

From publicly available sources.  We may collect Personal Information about you from publicly available sources such as social media (e.g., LinkedIn, Facebook, etc.), company websites, or government-run websites.    

From you.  When you seek or use our services, express interest in or apply for an employment opportunity, work for us, visit our offices, visit our Site, or seek to do business with us, you may provide us with Personal Information. 

From our clients.  Our clients will provide us with your Personal Information while providing services to them.   

What about the quality of Personal Information? 

The Personal Information we obtain and process shall be adequate, relevant, and not excessive in relation to the purposes for which the Personal Information is processed.  When we store your Personal Information, we will take reasonable steps necessary to ensure that such information is not alterable, except by those authorized to do so, for necessary reasons only, and for reasons authorized by applicable law.   

Why do We process Personal Information? 

We collect your Personal Information for the following reasons: 

In the ordinary course of business.  You may provide us with your Personal Information, including name, social security number, address, date of birth, and contract information, in order that we, through our own company or one of our subsidiaries – e.g., Systems & Services Technologies, Inc. – may service a product you have obtained with one of our clients.   

The processing of such information is necessary to comply with applicable laws or to properly service your product.   

For a potential employment opportunity.  You may provide us with your Personal Information, such as a resume, curriculum vitae, and social security number, or other identifying information in connection with a potential employment opportunity at Alorica, whether advertised on the Alorica website or otherwise.  

We may use this information throughout Alorica for the purpose of your employment consideration. We also may share and use the information on your job application with third parties/suppliers, such as background services and our affiliates, to evaluate and analyze your potential employment.  

In addition, if Personal Information is provided as part of an employment opportunity covered under an applicable law, the specific Alorica recruiting process for that opportunity may provide additional disclosures at the time of obtaining that Personal Information. 

For our current employment relationship.  We will process your Personal Information to manage our employment relationship with you, and to fulfill our obligations to you as your employer, including on-boarding, processing payroll, administering benefits, administering retirement, managing personal time off/ personal leave/ FMLA/ vacation/ etc., tax reporting, and so forth.   

For former employment relationships.  We will keep your Personal Information as long as necessary, but no longer than reasonably necessary to comply with all applicable employment-related laws and other legal concerns. 

For marketing purposes.  We will utilize your Personal Information to market our services to you or the company you work for, after we have determined that You work for a company that could potentially benefit from our services, and that you are a person in a position to discuss Alorica’s services for your company.   

For other legally required purposes.  We may process your Personal Information when necessary to comply with laws and regulations – e.g., minimum wage laws, labor laws, tax laws, health and safety, anti-discrimination laws, migration, and data subject rights.  

For other legally permitted purposes.  We may process your Personal Information to measure and improve upon internal processes and policies, by using work data to conduct research into efficiencies, human resources, training development, and product development.  Where possible, we will anonymize your Personal Information, and where required by law, will eliminate all personal identifiers.

Do We sell Personal Information? 

We do not sell Personal Information.  However, our clients are not bound by this Privacy Notice and therefore may sell Personal Information we process on their behalf.

How We share your Personal Information with third parties? 

We may share your information with third parties, including the following:  

Our clients.  We may share your Personal Information with our clients as reasonably necessary to provide the services we are providing them.   

Our vendors.  We may share your Personal Information with our vendors for the purpose of providing us or our clients with services.  Examples include payroll administrators, benefits administrators, and entities conducting background checks on you.   

Assignees.  Our clients may assign your account to a third party.  Upon our client’s direction, we will share your Personal Information with this third-party assignee.    

Credit reporting agencies.  If servicing your account, we may share account information with credit reporting agencies in accordance with applicable law.   

Government agencies.  Where required, we will share your Personal Information with government agencies.   

We will only disclose your Personal Information to the relevant parties to the extent necessary.  Where possible, we will enter into strict confidentiality agreements and data processing agreements with such third parties and require them to process Personal Information in accordance with our requirements, this Privacy Notice, and the confidentiality and security measures required by applicable laws and regulations. 

How do We protect your Personal Information? 

We protect your Personal Information utilizing a comprehensive Data Security infrastructure, including:

Data security.  We maintain organizational, physical, and technical security arrangements for all the Personal Information we hold. We have protocols, controls and relevant policies, procedures, and guidance to maintain these arrangements considering the risks associated with the categories of Personal Information and the processing we undertake.

We comply with all applicable data protection laws, and secure numerous market leading security measures to protect Personal Information, including several well-known market certifications like SOC 1, PCI-DSS, and ISO27001. 

We have regular penetration testing performed by a third-party provider to identify and remediate discovered vulnerabilities. 

We work to protect the security of your Personal Information at rest and during transmission by using encryption protocols and software. 

Using information security and quality technology.  We implement commercially standard measures and processes, such as using encryption when transmitting sensitive information, with the goal of maintaining and securing the privacy of your Personal Information.

Workplace security and monitoring.  Alorica monitors its network infrastructure through automated tools such as network authentication, anti-malware software, data-loss protection tools, website filtering and spam filtering software, and access and transaction logging.  The purpose of this monitoring is to protect Alorica, its employees, its clients, and its customers from harm. 

We may also use vendors to ensure the security of Personal Information as described above. 

We also monitor our offices through video monitoring – e.g., closed-circuit television, badge scans, and biometric data for health and safety screening.  CCTV is primarily used in public areas for security reasons only - CCTV is not used in private spaces such as restrooms or locker rooms.

Security education.  We provide all Alorica employees with training and education on their security obligations to protect the confidentiality, integrity, and availability of Personal Information and on how to report potential security incidents.  We provide phishing and spamming alerts when such threats are identified, or where we receive notice of such threats from third parties.   

Human resources.  Alorica employees sign confidentiality agreements and acknowledge security and privacy policies.   All Alorica employees should understand that any message, files, data, document, or other such electronic communication transmitted on premises, or through Alorica IT communications systems and assets are presumed to be business-related and therefore the property of Alorica and may be monitored or accessed by us in accordance with applicable law.

In addition, Alorica employees should also be aware that each call they participate in may be recorded, and that such recording may be shared with third parties for auditing/ quality control purposes, or any other purpose permitted by applicable law.    

Privacy Impact Assessments.  Alorica analyzes how PII is collected, used, shared, and maintained.  The purpose of this analysis, known as a Privacy Impact Statement (PIA), is to demonstrate that program managers and systems owners consciously incorporate requisite privacy protections throughout the life cycle of Alorica’s processing of information. 

Incident management.  Alorica has designed incident processes and procedures to detect and respond to incidents that may affect the confidentiality, integrity, and availability of Personal Information.  These processes are designed to identify a potential breach, secure operations, and isolate the breach and remediate potential impact, analyze, and fix any identified vulnerabilities, identify affected individuals, and notify them as warranted, and to assess the incident to determine what proactive steps must be implemented to prevent the incident from occurring again.

Continuous improvement.  Alorica’s security posture is based on a continuous improvement process that includes periodic review of security controls effectiveness and, where issues are identified, implementing a plan to remediate any identified vulnerabilities. 

Vendor/ subcontractor management.  In some cases, in the ordinary course of business, we may use suppliers to collect, use, analyze and otherwise process information on our behalf.

Some such instances include:

  1. To carry out the purposes of this Notice;
  2. To enable third parties to provide services for Alorica, including financial investment service providers, insurance providers, benefits providers, payroll support services, taxes, facility management, and legal service providers;
  3. To comply with legal obligations, or to respond to a government inquiry;
  4. To seek legal advice from counsel, and as necessary to establishing a defense against potential, threatened, or actual litigation;
  5. To third-party vendors conducting or supporting a necessary part of Alorica’s business operations.

It is our policy and practice to require such suppliers to handle information in a manner consistent with our security measures and processes.

Although we have taken reasonable and effective measures as described above and comply with the standards required by the applicable laws and regulations, we still cannot guarantee the security of your Personal Information when you are communicating through insecure means. Therefore, You should take active measures to ensure the security of Your Personal Information, such as regularly changing your email account password and not disclosing your account password and other Personal Information to others.

We have put in place procedures to deal with any suspected Personal Information breach and will notify you and any applicable regulatory authority of a breach where we are legally required to do so.

You understand that the Personal Information protection measures we take only apply to the Personal Information you provide to us. Once you use other websites, services, and access other content resources, we have no ability or obligation to protect any Personal Information you submit on other websites, regardless of whether your access to or browsing of the above websites is based on a link or guide in our website.

How long do we keep Personal Information?

We will maintain your Personal Information if we still have an ongoing relationship with you, if needed to provide services to you, and if required by applicable law or governing contract.  In short, we will keep your Personal Information if it is necessary to do so for business purposes or legal requirements, after which point your Personal Information will be deleted and purged from our systems.   

Where will your Personal Information be processed?

As a global organization with offices and operations throughout the world, Personal Information we collect may be transferred or be accessible internationally throughout Alorica’s global business and between its affiliates and clients.

Additionally, Alorica will process Personal Information belonging to its clients in the country in which the work is being performed.  Alorica will work with its clients to take all appropriate steps to ensure that such international transfers of Personal Information comply with all applicable law. 

If I exercise any rights described herein, are there any consequences to me?

Should you elect to exercise or attempt to exercise any rights described herein, Alorica will not take any retaliatory action against you.  For example, unless the applicable law provides an exception, we will not:

  • Deny you goods or services;
  • Charge you different prices or rates for goods or services;
  • Provide you a different level or quality of goods or services; or
  • Deny you employment or take retaliatory employment actions against you. 
Will any of my Personal Information be processed for the purpose of automated decision making? 

Alorica uses and intends to use artificial intelligence ("AI") to assist in making decisions concerning its business practices and employment decisions, and your Personal Information may be used as part of that process.  However, Alorica uses these tools only as guides to assist in its decision making and does not make decisions based solely on automated decision-making tools, and will use AI in accordance with all applicable data privacy laws, and those laws specifically relating to the use of AI. 

Conflict Between the Notice and Local Laws and Regulations 

When local laws and regulations require a higher level of protection for your Personal Data, they take precedence over the Notice. In addition, the specific requirements of the Notice apply only when local laws and regulations permit.

California Privacy Notice

Alorica conducts business in every State and must therefore comply with each State’s privacy regulations.  The below notice governs with respect to any data processing activities that take place within California and incorporates Alorica’s General Privacy Policy.  To the extent this Policy conflicts with Alorica’s General Privacy Policy, this one governs.

Information We Collect. 

We collect information that identifies, relates to, describes, references, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular consumer or device (“Personal Information”).

We have collected the following categories of Personal Information from consumers within the last twelve (12) months:

Personal Information does not include: Publicly available information from government records; Deidentified or aggregated consumer information; Information excluded from the CCPA’s scope, like: health or medical information covered by the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and the California Confidentiality of Medical Information Act (CMIA) or clinical trial data or Personal Information covered by certain sector-specific privacy laws, including the Fair Credit Reporting Act (FCRA), the Gramm-Leach-Bliley Act (GLBA) or California Financial Information Privacy Act (FIPA), and the Driver’s Privacy Protection Act of 1994.

We obtain the categories of Personal Information listed above from the following categories of sources: directly from you; indirectly from you, our clients, or their agents, for example, through information we collect from our clients while providing services to them; and directly and indirectly from activity on our website, computers, and phones. For example, from submissions through our website portal or website usage details collected automatically.

Use of Personal Information. 

We may use or disclose the Personal Information we collect for one or more of the following business purposes: to fulfill or meet the reason for which the information is provided, for example, as part of the services that Alorica offers to its clients, when you provide us with Personal Information as part of a transaction or inquiry, we will use that information to verify identity, retrieve account information, process payment, or respond to your inquiry; to carry out our obligations and enforce our rights arising from any client contracts entered into services; for quality assurance and regulatory compliance; as necessary or appropriate to protect the rights, property or safety of us, our clients or others; to respond to law enforcement requests and as required by applicable law, court order, subpoena, or governmental regulation; in response to a lawful request by a public authority, including to meet national security or law enforcement requirements, or similar legal process; as described to you when collecting your Personal Information or as otherwise set forth in the applicable data privacy laws; and to evaluate or conduct a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, in which Personal Information held by us is among the assets transferred.

Sharing Personal Information. 

We may disclose your Personal Information to a third party for business purposes only as directed by Alorica’s client in connection with the account you have with that client or to further the services you receive or have received from that client. When we disclose Personal Information for a business purpose, we enter a contract that describes the purpose and requires the recipient to both keep that Personal Information confidential and not use it for any purpose except performing the contract.

In the preceding twelve (12) months, we have disclosed the following categories of Personal Information for a business purpose:

Category A: Identifiers.
Category B: California Customer Records Personal Information categories.
Category C: Protected classification characteristics under California or federal law.
Category I: Professional or employment-related information.

We disclose your Personal Information for a business purpose to the following categories of third parties: Our affiliates; Service providers; and Third parties to whom you authorize us to disclose your Personal Information in connection with employment, products, or services we provide to you. In the preceding twelve (12) months, we have not sold any Personal Information. Alorica does not sell any Personal Information for any purpose whatsoever.

Your Rights According to the California Privacy Act

Although Alorica is not a “Business” as defined in the CCPA, it will attempt to provide responses to legitimate and verified written requests for information pursuant to the CCPA. Deletion request rights

Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your Personal Information from our records, unless an exception applies. Please be advised that Alorica will generally deny a request to delete information if you are a current customer of one of Alorica’s clients or if you are a former customer of one of Alorica’s clients due to compliance with a legal obligation or to make other internal and lawful uses of that information that are compatible with the context in which you provided it.

Only you or a person registered with the California Secretary of State that you authorize to act on your behalf, may make a verifiable consumer request related to your Personal Information. You may also make a verifiable consumer request on behalf of your minor child.

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (i) Provide sufficient information that allows us to reasonably verify you are the person about whom we collected Personal Information or an authorized representative and (ii) Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We cannot respond to your request or provide you with Personal Information if we cannot verify your identity or authority to make the request and confirm the Personal Information relates to you. Making a verifiable consumer request does not require you to create an account with us. We will only use Personal Information provided in a verifiable consumer request to verify the requestor’s identity or authority to make the request.

Response timing and format

We endeavor to respond to a verifiable consumer request within 45 days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing. We will deliver our written response by mail or electronically determined by the method of submitting the verifiable consumer request. Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your Personal Information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.

We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

Transfer of Data to Third Party Countries

GDPR allows cross-border data transfers to third countries only if certain conditions are met - in order of preference, they are: 

Adequacy decisions:  The European Commission decides whether such a third country ensures an adequate level of protection for personal data. Once an “adequacy decision” is made, personal data can be transferred to the third country without any further safeguards.  Alorica may transfer information within the EU or to other countries subject to such adequacy decisions. 

Standard contractual clauses (SCCs): The European Commission has approved standardized contractual clauses that can be used by organizations within a data protection/ processing agreement (“DPA”) to ensure that personal data transferred to third countries is adequately protected.  Where Alorica transfers data to a country not subject to an adequacy decision, Alorica will endeavor to draft a DPA containing all appropriate SCCs. 

Derogations: GDPR allows for certain derogations (or exceptions) that allow organizations to transfer personal data to third countries without the need for specific safeguards.  One such derogation is individual consent.

As such, if you are an EU data subject, this is intended to notify you that where permitted by applicable law, we may transfer the personal data we collect about you to the United States and other jurisdictions that may not be deemed to provide the same level of data protection as your home country for the purposes set out in this Privacy Notice, and we may transfer such information without appropriate safeguards in place.

How do we respond to your request

We will respond to all requests we receive from individuals who intend to exercise their rights to Personal Information according to China Data Protection Law.  Before we respond to a communication or request, we may take certain steps to verify the requestor’s identity and the authenticity of a request.  Where we have reasonable doubts concerning the identity of the person making the request, or the authenticity of a request, we may request such additional information as we deem necessary to satisfy ourselves of their identity and authenticity of their request.  If we cannot satisfactorily verify the identity of a requestor and the authenticity of a request, we will not be able to take any action pursuant to the request.

To facilitate this process and to enable us to assist you, when you make a request to us, please specify the type of request you are making, and provide us with your name, e-mail and telephone number, and satisfactory evidence of your identity. We will use your information only to verify your request by attempting to match your information to our internal records.

Under the following circumstances, we will be unable to address your requests:

  • The request violates our obligations under laws and regulations;
  • Addressing the request will threaten national security and defense;
  • Addressing the request will jeopardize public health or important public interests;
  • Addressing the request will affect a criminal investigation, prosecution, trial, or the execution of a judgment;
  • We have sufficient evidence proving that you possess a malicious intent or are abusing your rights;
  • Where trade secrets are involved;
  • Other circumstances where entertaining your request will seriously jeopardize the legitimate rights and interests of other individuals or organizations.

There is generally no charge for the exercise of your legal rights. However, if your requests are manifestly unfounded or excessive, in particular because of their repetitive character, we may either:  

  • charge a reasonable fee considering the administrative costs of providing the information or taking the action requested, or
  • refuse to act on the request.

We try to respond to all legitimate requests within 15 working days. If your request is particularly complex, or if you have already made multiple requests, it may take us longer than 15 working days to process your request. In this case, we will notify you and keep you updated.
